1. Acceptance of Terms
By using Euthy Journal, you agree to these terms. Euthy Journal is created and operated by Euthy Labs. If you do not agree, please do not use the app.
2. Age Requirement
You must be at least 18 years of age to use Euthy Journal. By using the app, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Ownership of Content
You retain 100% ownership of everything you write, record, or upload to Euthy Journal, including any text or voice inputs you submit to the optional AI features, and any outputs or summaries generated by the AI. We do not claim any rights to your content or AI responses. Your journal data is stored privately on your device and, if you choose to enable Automated Cloud Backups, your personal Apple iCloud or Google Drive account. It is never stored on our servers.
4. Data Responsibility & Loss
Euthy Journal is a local-first application. This means your journal data primarily lives on your device and may also exist in backup archives within your personal cloud account. We are not responsible for any data loss resulting from device failure, app deletion, loss of your device, account security breaches, failed backups, corrupted files, personal cloud storage limits, or connectivity issues. It is your responsibility to manage your own cloud account and security.
5. Not Medical Advice & AI Accuracy
Euthy Journal provides tools for self-reflection and personal insights. It is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any mental or physical health condition. The 'Insights', 'Recovery Signals', 'Health Correlations', 'Mood Tracking', and optional AI features (including the AI Companion chat and history Q&A) are for informational and reflective purposes only. The AI companion is powered by Large Language Models which can make mistakes or hallucinate inaccurate information. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN THIS APP OR PROMPTED VIA THE AI.
Euthy Journal and its AI features are not crisis services. If you are experiencing a mental health emergency, please contact local emergency services or a crisis hotline immediately.
6. Imports, Exports & Third-Party Services
Euthy Journal can import supported backup and export files from Euthy Journal and certain third-party journal apps. Imports may overwrite existing data, so you should create a current backup before importing. Third-party app names are used only to describe compatible export formats. Day One, Journey, Daylio, Diarly, Diarium, and Stoic are trademarks of their respective owners. Euthy Journal is not affiliated with or endorsed by them.
7. Premium Subscriptions
Premium features are billed on a subscription basis. Payments are handled by the Apple App Store or Google Play Store. You can manage or cancel your subscription at any time through your device's store settings.
Pricing and Limit Modifications: We reserve the right to modify our subscription tiers, pricing models, rate limits (including the daily AI requests quota), and featured capabilities at any time. Any changes to pricing will be communicated in advance via email or account notification from the Apple App Store or Google Play Store, and will only apply to subsequent billing cycles in compliance with store billing policies.
8. Limitation of Liability
To the maximum extent permitted by law, Euthy Journal is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost journal entries, lost backups, data corruption, or loss of access to the app.
9. Analytics & Optimization
We may use analytics, performance monitoring, and crash reporting to improve app stability and performance. These services may collect technical diagnostics and anonymous usage patterns such as app version, device model, operating system version, crash logs, and feature interactions. They do not collect your private journal entries, photos, drawings, voice notes, routines, saved health snapshots, or other private journal content.
10. Backend, API & Cloud Features
We may add backend, account, API, or optional cloud-connected features in the future. Those services may be used to provide requested app functionality, subscription support, cloud backups, or account-related features. For Premium AI subscribers, we utilize Google Cloud Platform (GCP & Vertex AI) to process companion chat and history search statelessly and in real-time. While your private journal entries and generated images are processed completely statelessly and are never stored, cached, or logged by Google Cloud servers, we securely track and store your remaining monthly credit balances against your pseudonymous Support ID in Google Cloud Firestore (located in the United States) to manage your premium AI quota and prevent rate-limiting abuse. No personally identifying data (such as emails, names, or device hardware IDs) and no journal contents are ever stored in this database. Purchasing a Premium AI subscription requires signing in with Apple or Google to establish a stable, pseudonymous Support ID for credit management. Restoring a previous purchase does not require signing in and can be done using your existing Support ID. We will not use backend services to store or analyze your private journal content unless a feature clearly asks for your permission and you choose to enable it.
11. AI Acceptable Use & Fair Use Policy
Premium AI subscription plans grant access to cloud-based generative AI features (including companion chat, entry analysis, and image generation/editing). To ensure fair availability, stability, and control server costs, these features are subject to Fair Use rate limits (which are dynamically managed to ensure server stability, fair availability, and control operational costs). You agree not to use the AI features in an abusive manner, which includes but is not limited to: automating queries via bots or scripts, attempting to scrape model outputs, reverse-engineering API endpoints, or generating illegal, harmful, hateful, or sexually explicit content that violates third-party developer policies (such as Google Gemini/Vertex AI terms). We reserve the right to temporarily suspend, throttle, or terminate your access to AI features if we detect suspicious, automated, or abusive patterns of usage, without refund of your subscription fees.
12. Cloud Integration
When using Google Drive or iCloud for backups, you are subject to their respective terms. We only request the minimum permissions necessary to store and retrieve your journal backups. Euthy Journal utilizes restricted app-specific storage; we do not have access to your account credentials or any data outside of the Euthy Journal backup files.
13. Third-Party Map and Location Services
Euthy Journal utilizes native map services (such as Apple Maps or Google Maps) to provide location tagging and map viewing features. By using these features, you also agree to be bound by the respective Terms of Service of those third-party map providers. Euthy Journal is not responsible for the accuracy of geocoding data or map displays provided by these third parties.
14. Changes to Terms
We may update these terms from time to time. Your continued use of the app after changes are made constitutes your acceptance of the new terms.
